Discusses the many injustices that children who have been the victims of incest suffer in our present court system.  The courts are returning children to parents who are accused of molesting them, in spite of significant physical and psychological evidence that the abuse occurred.  This article discusses how courts work and how they have little patience with a parent who will not compromise.  "If a parent believes the child's story that the abuse happened, reports the abuse to the proper authorities, feels anger toward the perpetrator, that parent is considered by the court to be unreasonable." However, these responses would be considered normal if the perpetrator were not a family member. 
Backlash groups have painted pictures of modern day witchhunts and McCarthy-type hearings, attempting to shift the focus from abused children to innocent fathers who are being persecuted by vindictive wives.  Recent studies have shown that there is no evidence to support the idea the incidence of false accusations is higher in divorce-custody cases. Even when allegations are proved to the court's satisfaction, the judge may order supervised visitation. Court-ordered visitation between a rape victim and a rapist in any other context would be a judicial outrage. However, in incest cases this is considered acceptable.

"Because of the use of PAS as a tactic by many CSA perpetrators to influence decision makers and the court system, abused children have been placed in the hands of their abusers (Childress, 2006). It is estimated that “over 58,000 children a year are ordered into unsupervised contact with physically or sexually abusive parents following divorce in the United States” (http://www.leadershipcouncil.org/1/pas/1.html) and that PAS was used in a large number of these cases".

Because Gardner 's PAS theory is based on his clinical observations--not scientific data--it must be understood in the context of his extreme views concerning women, pedophilia and child sexual abuse.
Richard A. Gardner, M.D., is the creator of the creator and main proponent for Parental Alienation Syndrome (PAS) theory. Prior to his suicide, Gardner was an unpaid part-time clinical professor of child psychiatry at the College of Physicians and Surgeons at Columbia University . He made his money mainly as a forensic expert. 
PAS was developed by Dr Richard Gardner in 1985 based on his personal observations and work as an expert witness, often on behalf of fathers accused of molesting their children. Gardner asserted that PAS is very common and he saw manifestations of this syndrome in over 90% of the custody conflicts he evaluated--even when abuse allegations are not raised (Gardner, 1987, p. 67).1Gardner (September 6, 1993) claimed that PAS is "a disorder of children, arising almost exclusively in child-custody disputes, in which one parent (usually the mother) programs the child to hate the other parent (usually the father)."2 
Gardner 's theory of PAS has had a profound effect on how the court systems in our country handle allegations of child sexual abuse, especially during divorce. Gardner has authored more than 250 books and articles with advice directed towards mental health professionals, the legal community, divorcing adults and their children. Gardner 's private publishing company, Creative Therapeutics, published his many books, cassettes, and videotapes.3 Information available on Gardner 's website indicates that he has been certified to testify as an expert in approximately 400 cases, both criminal and civil, in more than 25 states.4Gardner 's work continues to serve as a basis for decisions affecting the welfare of children in courtrooms across the nation. He is considered a leading authority in family courts and has even been described as the "guru" of child custody evaluations.4

How Many Children Are Court -Ordered Into Unsupervised Contact With an Abusive Parent After Divorce?

According to a conservative estimate by experts at the Leadership Council on Child Abuse and Interpersonal Violence (LC), more than 58,000 children a year are ordered into unsupervised contact with physically or sexually abusive parents following divorce in the United States. This is over twice the yearly rate of new cases of childhood cancer.  
Experts at the LC consider the crisis in our family courts to constitute a public health crisis. Once placed with an abusive parent or forced to visit, children will continue to be exposed to parental violence and abuse until they reach 18. Thus, we estimate that half a million children will be affected in the US at any point of time. Many of these children will suffer physical and psychological damage which may take a lifetime to heal. The Leadership Council urges citizens to work with legislators and agencies in their communities to examine this problem, review state agency policies and procedures, and develop legislative and policy solutions that help ensure safety from violence for children following divorce.

EXCERPTS:" Lawyers'  unacknowledged conflicts are destroying the quality of family law representation. One of the problems with the rise of therapeutic jurisprudence and the placement of non-legal systems into the courts is the subtle denigration of long-established precepts of lawyer independence and due process. One of the multiple ways this happens in the family courts is through the common development of multidisciplinary collegial relationships and business referral.
The conflict arises because most lawyers represent different clients taking different sides in different cases (sometimes the wife, sometimes the husband, sometimes the "good guy", sometimes the "bad guy", etc.). If a lawyer coming into a case runs up against an expert he has a referral or employment relationship with in other cases, and that expert takes an adverse position to the lawyer's client in the new case, the lawyer will have a very difficult time adequately representing his client. Appropriate representation may require the lawyer to strenuously object to an expert's testimony -- or even the expert himself. But if the lawyer needs the good will and cooperation of the expert in connection with the lawyer's other clients' pending cases, he cannot do that because he may put those other cases at risk."
